These Terms of Service ("Terms") govern your access to and use of our equipment rental services, website, and any related products and services (collectively, the "Services"). By renting equipment from us, using our website, or signing any rental documentation, you agree to these Terms. If you do not agree, you may not use our Services.
1. Who We Are
These Terms are between you ("you" or "Customer") and Stober & Sons Equipment and Attachments, an equipment rental company located at Mile 124.5 Tok Cutoff, Tok, Alaska 99780. All references to "we," "us," or "our" mean Stober & Sons Equipment and Attachments and our authorized employees and representatives.
2. Eligibility
To rent or use equipment from us, you must:
- Be at least 18 years old (or older if required by law for certain equipment).
- Be legally capable of entering into binding contracts.
- Provide accurate and complete information when requested (including identification, contact, and payment details).
We may refuse service, cancel a rental, or require additional documentation at our discretion, as permitted by law.
3. Reservations and Rentals
3.1 Requests and availability
Rental requests may be made in person, by phone, or (if available) through our website or online forms. All rentals are subject to equipment availability, our approval, and payment or deposit requirements. We may cancel or decline any reservation at our discretion, for example if we suspect misuse, safety concerns, or nonâpayment.
3.2 Rental period
The rental period begins when you take possession of the equipment (or when we deliver it, if applicable) and ends when we receive the equipment back at our designated location during our normal business hours, unless otherwise agreed in writing. Daily, weekly, and monthly rates are based on our posted or quoted pricing and are subject to minimum rental periods.
3.3 Extensions and early returns
If you want to extend your rental, you must contact us before the end of the current rental period. Approval of an extension is subject to availability and our discretion, and may involve additional charges. Early returns do not necessarily result in a refund of unused time unless we have agreed otherwise.
4. Rates, Deposits, and Payments
4.1 Pricing and taxes
Rental rates, fees, and charges are as quoted at the time you place your order or sign the rental documents. Prices may change at any time, but changes will not affect rentals that we have already confirmed, except as allowed in these Terms.
4.2 Deposits
We may require a security deposit before reserving or releasing equipment. Reservation security deposits may be forfeit if the rental is not consummated. The deposit amount and form (for example, card hold or cash deposit) will be disclosed at the time of reservation or rental. We may use some or all of the deposit to cover unpaid rental charges, loss, damage, cleaning, or other amounts you owe under these Terms. Any remaining deposit will be released or returned after final inspection and settlement of charges, in line with our normal processes and timelines.
4.3 Payment terms
You agree to pay all rental charges, delivery and pickup fees, cleaning fees, damage or loss charges, and other amounts specified in the rental agreement, invoice, or these Terms. Payment is due as stated in your rental documents, and may be required in advance. By providing a payment method, you authorize us to charge that method for all amounts you owe, including additional charges incurred under these Terms.
5. Customer Responsibilities
5.1 Proper use
You agree to:
- Use the equipment only for its intended purpose and in a careful, safe, and lawful manner.
- Follow all operating instructions, safety warnings, and training we provide or that are provided by the manufacturer.
- Comply with all applicable laws, regulations, and industry standards.
You must not use the equipment while under the influence of drugs or alcohol or allow unauthorized or untrained persons to operate it.
5.2 Condition and inspection
You should inspect the equipment at the time of pickup or delivery and report any visible damage or defects before you use it. If you use the equipment without notifying us of a problem, we may consider it to be in good condition at the start of your rental, except for normal wear.
5.3 Care, maintenance, and security
You are responsible for keeping the equipment in your possession and control, and for taking reasonable steps to protect it from loss, theft, damage, or misuse, including:
- Storing it in a secure location.
- Protecting it from weather and other environmental damage when reasonably possible.
- Using proper fuel, fluids, and attachments where applicable.
You must not modify, alter, or repair the equipment unless we have given prior written approval.
5.4 Return of equipment
You must return the equipment on or before the agreed due date, during our normal business hours, to the location we specify, in the same condition you received it, ordinary wear and tear expected. Equipment must be clean and free of excessive dirt, debris, or contamination. If equipment is not returned on time, we may charge additional rental fees, late fees, or retrieval costs, and we may consider the equipment lost or stolen as allowed by law.
6. Damage, Loss, and Theft
You are responsible for any loss, theft, or damage to the equipment from the time you take possession until the time we receive it back, except for ordinary wear and tear. If equipment is lost, stolen, destroyed, or damaged beyond normal wear, you may be charged the reasonable cost of repair or, if repair is not feasible, the replacement cost (less any amount recovered from insurance, if applicable).
If equipment is lost or stolen, you must promptly notify us and, if applicable, law enforcement. You must cooperate with us and any insurer in any investigation or claim.
7. Delivery and Pickup (If Offered)
If we offer delivery and/or pickup services and you elect to use them:
- Delivery and pickup times are approximate and may vary due to traffic, weather, or other conditions.
- You are responsible for providing safe and accessible delivery and pickup locations.
- Our responsibility for the equipment transfers to you upon delivery and returns to us upon pickup, as indicated in the rental documents.
- Additional charges may apply if we are unable to complete delivery or pickup due to unsafe conditions, inaccessible sites, or your failure to be present when required.
8. Ownership and No Subârenting
All rented equipment remains our property (or the property of our lessors) at all times. You may not subârent, loan, sell, pledge, or otherwise transfer or encumber the equipment without our prior written consent. You must not remove or obscure any identification, ownership labels, safety labels, or serial numbers on the equipment.
9. Website Use and Accounts (If Applicable)
If we provide a website or online account system:
- You are responsible for maintaining the confidentiality of any login credentials and for all activities under your account.
- You agree not to use our website for any unlawful purpose or to attempt to gain unauthorized access to our systems.
- We may suspend or terminate online access at any time, with or without notice, as allowed by law and these Terms.
Content on our website (including text, images, and logos) is owned by us or our licensors and is protected by intellectualâproperty laws. You may not copy, modify, or use our content without permission, except for personal, nonâcommercial use directly related to renting from us.
10. Cancellations and NoâShows
Our cancellation and noâshow rules may vary by equipment type or season and may be described in your quote or rental confirmation. In general:
- We may charge a cancellation fee if you cancel within a certain time before the scheduled rental start.
- If you do not show up or fail to accept delivery at the agreed time without prior notice, we may treat it as a noâshow, cancel the rental, and charge applicable fees.
Any specific cancellation policies stated on your quote, confirmation, or rental agreement will apply in addition to these Terms.
11. Insurance and Risk Allocation
You are responsible for determining whether you need insurance coverage (for example, general liability, property, or equipment coverage) for your use of our equipment. We may offer or require certain insurance or damageâwaiver options, if available; the terms of any such coverage will be described separately.
Your use of the equipment is at your own risk. You are responsible for any bodily injury, property damage, or other loss arising from your use, operation, or possession of the equipment, except to the extent caused by our negligence or willful misconduct, as allowed by law.
12. Disclaimers
To the maximum extent permitted by law, the equipment and our Services are provided "as is" and "as available," without any warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or nonâinfringement.
We do not guarantee that particular equipment will always be available, that our website will be errorâfree or uninterrupted, or that all defects will be corrected.
13. Limitation of Liability
To the fullest extent permitted by law:
- Our total liability to you for any claims arising out of or relating to your rental or use of our Services will not exceed the total amount you paid to us for the rental or services giving rise to the claim.
- We will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages (including loss of profits, loss of business, or loss of use), even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you. In those cases, the limitations will apply to the greatest extent permitted by law.
14. Indemnification
You agree to indemnify, defend, and hold us and our owners, employees, and agents harmless from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of or related to:
- Your breach of these Terms or any rental agreement.
- Your use, operation, or possession of the equipment.
- Any injury, death, or property damage involving the equipment while it is in your care, custody, or control, except to the extent caused by our negligence or willful misconduct.
15. Termination
We may terminate or suspend your rental or access to our Services immediately, with or without notice, if you breach these Terms, misuse the equipment, fail to pay amounts due, or engage in unsafe or unlawful conduct. Upon termination, you must promptly return all equipment and pay any outstanding amounts owed. Sections of these Terms that by their nature should survive (such as payment obligations, limitations of liability, and indemnification) will remain in effect.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top. For significant changes, we may provide additional notice as required by law (for example, posting a notice on our website). Your continued use of our Services after changes take effect means you accept the updated Terms.
17. Governing Law and Disputes
These Terms and any disputes arising out of or related to your rental or use of our Services are governed by the laws of the State of Alaska, without regard to its conflictâofâlaws rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Alaska or another appropriate venue as allowed by law. You and we agree to submit to the personal jurisdiction of those courts.
18. Miscellaneous
If any part of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign our rights and obligations as part of a sale or reorganization of our business.
